DMCA Policy

Emerald Skyway Manufacturing LLC (“we,” “us,” “our”) respects intellectual property rights and expects others to do the same. If you believe content on our website infringes your copyright, you may submit a DMCA takedown notice. If you believe your content was removed by mistake, you may submit a counter-notice.

This policy follows the Digital Millennium Copyright Act (DMCA), 17 U.S.C. §512.

1) Reporting Copyright Infringement (DMCA Takedown Notice)

To file a DMCA notice, email us with the subject line:

“DMCA Takedown Notice – [Your Name / Company]”

Your notice must include all of the following:

Your contact information
- Full legal name
- Company (if applicable)
- Email address
- Phone number
- Mailing address
Identification of the copyrighted work you believe has been infringed
- A description of the original work
- A link to the original work (if available) or proof of ownership
Identification of the allegedly infringing material on our site
- The exact URL(s) on our website where the material appears
- Enough detail so we can find it quickly
A good-faith statement
You must state that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law.
An accuracy and authority statement (under penalty of perjury)
You must state that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.
Your physical or electronic signature
Typing your full legal name at the end counts as an electronic signature.

If your notice is missing any required items, we may not be able to act on it.

2) What Happens After a Valid Notice

Once we receive a complete DMCA notice, we may:

remove or disable access to the content
notify the user (if applicable)
take reasonable steps to prevent repeat infringement

We also reserve the right to terminate access for repeat infringers where appropriate.

3) Counter-Notification (If You Believe Removal Was a Mistake)

If you believe your content was removed due to error, misidentification, or you have the legal right to use it, you may file a counter-notice.

Email us with the subject line:

“DMCA Counter Notice – [Your Name / Company]”

Your counter-notice must include:

Your contact information
- Full legal name
- Email address
- Phone number
- Mailing address
Identification of the removed material
- The URL(s) and description of what was removed
A statement under penalty of perjury
That you believe the material was removed due to mistake or misidentification.
Consent to jurisdiction
You must consent to the jurisdiction of the federal court in your district (or if outside the U.S., a U.S. judicial district where we may be found), and agree to accept service of process from the party who submitted the original DMCA notice.
Your electronic or physical signature
Typing your full legal name counts as an electronic signature.

4) Misuse of This Process

Submitting false or misleading DMCA notices or counter-notices may result in legal consequences. The DMCA is not a toy for taking down competitors because you’re feeling petty.
